한국장애포럼(KDF)은 장애여성공감과 함께 유엔 여성차별철폐위원회의 한국 정부에 대한 사전질의목록(List of Issues) 시민사회 보고서를 제출하였습니다. 정부의 여성가족부 폐지 움직임이 노골화되는 가운데, 폭력피해 장애여성에 대한 통합 지원 계획이 전무한 상황, 폭력피해 장애여성 쉼터가 일시적 보호의 기능이 아닌 장기 시설화가 되는 문제, 장애여성의 성과 재생산권리에 대한 지속적이고 심각한 침해, 여전히 모성권 보호 일변인 장애여성 지원 현황 등이 이번 보고서에 담겼습니다.

그리고 올해 3월 1일 최종 채택된 질의목록 중 두 개 부문에서 장애여성에 대한 특별한 질의가 있음을 확인하였습니다. 해당 질의는 다음과 같습니다.
여성에 대한 차별의 법적 프레임워크 및 정의
3. 위원회의 이전 권고(13단락)와 후속 보고서(CEDAW/C/KOR/FCO/8, 2단락)에 제공된 정보에 비추어, 포괄적인 여성차별금지법의 개발과 채택을 촉진하기 위한 조치에 대한 업데이트된 정보를 제공해주십시오. 빈곤 여성, 민족, 인종, 종교 및 성 소수자 집단에 속한 여성, 장애여성, 여성 난민 및 망명 신청자, 무국적자 및 이주 여성, 농촌 여성, 독신 여성, 사춘기 소녀 및 고령 여성 등 취약한 여성 집단에 영향을 미치는 직접, 간접 및 교차 형태의 차별을 포함하여 본 협약 제1조에 정의된대로, 그리고 협약 2조에 대한 의무를 규정한 일반논평 28호(2010)에 따라 여성에 대한 차별을 금지하는 포괄적 차별금지법의 개발 및 채택을 촉진하기 위해 취한 조치에 대한 최신 정보를 제공해 주십시오.
Legislative framework and definition of discrimination against women
3. In the light of the Committee’s previous recommendations (para. 13) and information provided in its follow-up report (CEDAW/C/KOR/FCO/8, para. 2), please provide updated information on actions taken to expedite the development and adoption of a comprehensive anti-discrimination law that prohibits discrimination against women, including direct, indirect and intersecting forms of discrimination affecting disadvantaged groups of women, such as women living in poverty, women belonging to ethnic, racial, religious and sexual minority groups, women with disabilities, women refugees and asylum-seekers, stateless and migrant women, rural women, single women, adolescent girls and older women, as defined in article 1 of the Convention and in line with the Committee’s general recommendation No. 28 (2010) on the core obligations of States parties under article 2 of the Convention.
여성에 대한 젠더 기반 폭력
8. 위원회의 이전 권고(23항)에 비추어, 접근금지명령 또는 보호명령 위반에 대한 가해자의 처벌을 규정하고 있는지, 그 적용 대상을 성적 지향이나 성별 정체성에 관계없이 동성 커플, 동성 커플이 부양하는 가정 및 모든 여성으로 확대하는지를 포함하여 가정폭력범죄의 처벌 등에 관한 특례법 개정안의 추진 현황을 명확히 밝혀주시기 바랍니다. 가정폭력에 대한 구체적인 국가 행동 계획이 계획되어 있는지 명확히 밝혀주세요. 또한 가정폭력에 대한 상담이나 교육을 받는 조건으로 가정보호사건의 기소를 유예하는 제도를 폐지하고, 해당 사건에서 화해 및 조정의 활용을 금지하는 조치에 대한 구체적인 내용을 제공해 주십시오. 그 외의 노력에 대해서도 위원회에 보고해 주시기 바랍니다:
(h) 쉼터에 거주하는 젠더 기반 폭력 피해 여성과 소녀, 특히 장애 여성과 소녀가 지역사회에서 독립적으로 생활할 수 있도록 지원하며, 이를 위해 구체적인 정책, 지침 및 예산 배정 계획;
(i) 젠더 기반 폭력의 피해자인 장애 여성과 소녀에 대한 데이터를 장애 유형 및 폭력 유형별로 세분화하여 수집.
Gender-based violence against women
8. In the light of the Committee’s previous recommendations (para. 23), please clarify the status of the bill to amend the Act on Special Cases concerning the Punishment, etc. of Crimes of Domestic Violence, including whether it provides for the punishment of the perpetrator for violation of a restraining order or a protection order, and if its applicability is extended to same-sex couples, families headed by same-sex couples and all women, regardless of their sexual orientation or gender identity. Please clarify whether a specific national action plan on domestic violence is envisaged. Please also provide details on measures taken to abolish the system of suspending charges in home protection cases on the condition of undergoing counselling or training on domestic violence, and to prohibit the use of reconciliation and mediation in such cases. In addition, please inform the Committee about efforts made:
(h) To support women and girl victims of gender-based violence living in shelters, especially women and girls with disabilities, to live in the community independently, including through specific policies, guidelines and budget allocations for this purpose;
(i) To collect data on women and girls with disabilities who are victims of gender-based violence, disaggregated by type of disability and type of violence.
